RENTAL TERMS AND CONDITIONS

On the terms and conditions outlined in this Agreement, the Company agrees to supply the Client item rental services.

The client believes that the company is qualified, experienced, and able to rent clothes and jewelry (both separately and together referred to as "Items") to the client.

IN CONSIDERATION OF the above-mentioned matters and of the mutual benefits and obligations set forth in this Agreement, the Client and the Company (each individually the "Party" and collectively the "Parties") to this Agreement agree as follows the receipt and sufficiency of which consideration is hereby acknowledged:

A. SERVICES PROVIDED: 

By signing this agreement, the Client authorizes the Company to offer the following services to the Client (the "Services"). You can browse the items online, reserve or rent a dress with or without jewelry, have the items mailed to you for a fee, pick them up in-store.

The Services shall encompass any additional duties that the Parties may decide to undertake

B. TERM OF AGREEMENT: 

Subject to an early termination as specified in this Agreement, the duration of this agreement (the "Term") will start on the date of this agreement and run concurrently with the completion of the Services. The Parties may agree in writing to an extension of the Term.

C. DAMAGES: 

  1. The Items are the Client's responsibility for upkeep.
  2. If the Items are lost, destroyed, or damaged in any way other than through normal wear and use, the Client shall be liable.
  3. Normal wear and tear consists of stains, tiny tears, missing buttons or beads, broken zippers, and any other minor damage that would be covered by the $10.00 rental insurance that was paid at the time of the booking or reservation.
  4. In the event that the client decides not to purchase the $10.00 rental insurance, the client will be responsible for paying for any small repairs that must be made once the items are returned. 
  5. The determination of whether damages above the standard wear and tear tolerance is reserved by the Company.
  6. The full retail value, plus any previously paid rental fees, will be charged for any returned items that are discolored or irreparably damaged. Before the scheduled booking date, the Company will get in touch with you and provide the Client with the choice of paying a security deposit or keeping a credit card on file. Clients who opt to have their credit card on file grant permission for the full retail value to be charged to their card. In the event that a client chooses to pay a security deposit, the company retains the right to keep the money.
  7. The loss of the items and/or irreversible damages are not covered by the $10.00 rental insurance.
  8. Except as authorized by the Company, no modifications are allowed to the Items (i.e. temporary hem tape). Any damages for seamstress services incurred to repair the adjustments will be the client's responsibility.
  9. The Company is the only one authorized to dry clean the items. The price of the Agreement includes the cost of dry cleaning the items.
  10. Ironing the items is not possible. If ironing the items results in any damage, the client is responsible. Light steaming is permissible to remove creases from the Items, unless otherwise approved by the Company.
  11. The business disclaims all liability for any harm resulting from an individual's sensitivity to the materials of the items or the chemicals used in the dry cleaning process.

D. TERMINATION

  1. Upon making a reservation or booking, the client is free to swap to a different item, subject to availability and the company's discretion, up to one calendar day prior to the scheduled shipment date or before picking up the original item. If a higher-value item is being switched, the client will be responsible for the difference in price.
  2. Prior to the first day of the Agreement, the Client may cancel the reservation or booking at any time.
  3. If the client cancels the booking or reservation 21 calendar days before the start of the Agreement, the client will get a full refund. 
  4. The client will get a store credit for future rentals with no expiration date if the termination is made within the 21 calendar days prior to the first day of the agreement.
  5. A booking or reservation made with shop credit cannot be canceled for a cash return once the client has received it. Subject to the Company's judgment and the Items' availability, the Client may, nevertheless, exchange Items.
  6. The client needs to present the original payment receipt in order for the refund to be processed.
  7. In-store or online (via email) store credit notes will be distributed.
  8. We are unable to give the client a refund or credit if they decide not to use or wear the items after picking them up or receiving them.
  9. If the client returns the items before the agreed-upon return date, they will not get a refund or other form of compensation.
  10. The Company is not able to reimburse any shipping, handling, or courier costs once the product has been dispatched. These fees are not refundable and were paid for by the client.
E. LATE CHARGES: 
  1. There is a $20.00 late fee per item per calendar day for returns that are received after the deadline.
  2. In addition to any relevant late fees mentioned above, the client will be charged the full retail value of the items if they are not returned within 5 calendar days of the planned return date.
  3. Only if the postmark of an item was made later than agreed upon by the Parties will items that were dispatched be charged late fees.
  4. In the event that a carrier delays, the client will not be assessed any late costs.

F. MISCELLANEOUS

  1. A choli blouse, a lehenga skirt, a dupatta (if appropriate), a kurta, a sherwani, and jewelry are examples of items that can be rented.
  2. Two, Four or eight calendar days are the agreement's length. Extended rentals are contingent upon the Company's decision-making and the Items' availability.
  3. The Client shall return to the Company any Items that are the Company's property upon the expiration or termination of this Agreement.
  4. After usage, items will be sterilised with rubbing alcohol or dry cleaned before next rental.
  5. Please wear undergarments with dresses for safety and hygiene reasons.

G. PERFORMANCE

  1. The Parties agree to make every endeavor to carry out this Agreement's provisions.

H. CURRENCY 

  1. The amounts stated in this contract are all stated in Canadian dollars.

TITLES/HEADING 

  1. Headings are inserted only for the convenience of the Parties and are not to be construed as part of the Agreement's interpretation.

GOVERNING LAW 

  1. The laws of the Province of Ontario shall apply to the interpretation and application of this Agreement.

SEVERABILITY 

  1. If any part of this agreement is found to be invalid or unenforceable, the remaining terms will remain legal and enforceable, and the invalid or unenforceable portions will be separated from the rest of the agreement.

WAIVER 

  • Neither party's waiver of the other's breach, default, delay, or omission of any provision of this agreement will be interpreted as a waiver of the other party's subsequent breach of the same or other provisions.

RISK WAIVER NOTICE:

There is occasionally a chance that this product could cause harm, damage, or other issues. The list of risks that the product presents should not be interpreted as comprehensive or all-inclusive.  Risks include of, but are not restricted to:

  1. Sensitivities: Individual or allergic responses to neodymium magnets.
  2. Pinch Hazard: Because of their powerful attraction to one another and to any iron-containing object, magnets can present a significant pinch hazard. Two attracting magnets can cause painful pinching of fingers and other body parts. 
  3. Electronic Hazard: When subjected to an excessively strong magnetic field, some electronic equipment that are susceptible to the magnetic fields of neodymium magnets may suffer permanent or temporary damage.
